Terms of Service for Kloovi

1) Acceptance of Terms

These Terms of Service ("Terms") govern your use of the Kloovi mobile application and related services ("Service"). The Service is provided by Fevzihan Alkan operating as an individual developer ("Kloovi", "we", "us", or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use Kloovi.

2) Eligibility and Accounts

You must be legally permitted to use the Service under the laws of your jurisdiction and meet minimum age requirements imposed by applicable law and the Apple App Store or Google Play policies.

You are responsible for:

• Providing accurate account information
• Keeping your credentials secure
• All activity that occurs under your account

You must notify us if you believe your account has been compromised.

3) Service Description

Kloovi helps users:

• Capture or upload clothing images
• Build and manage digital wardrobe items
• Generate and save outfit combinations
• Access optional paid subscription features

Certain features may require internet access, compatible devices, or third-party services.

4) Subscriptions, Billing, and Paid Features

Some features may be available through paid subscriptions.

• Subscription purchases are processed by Apple App Store or Google Play
• Subscription status and entitlement management may be handled through RevenueCat
• Billing, renewal, cancellation, refunds, and payment disputes are governed by the applicable store's terms and policies

Where Apple requires it, additional terms may apply as presented in the App Store (for example, standard end-user license terms for licensed applications).

Kloovi may change subscription offerings, prices, or feature access in the future where allowed by law and store policies.

5) Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, fraudulent, or abusive purposes
• Interfere with app security, availability, or normal operations
• Attempt unauthorized access to systems, accounts, or data
• Reverse engineer or misuse non-public functionality except where law expressly permits
• Upload content you do not have the right to use

We may limit, suspend, or terminate access for violations.

6) User Content and Permissions

You retain ownership of content you provide (such as photos and wardrobe entries).

You grant Fevzihan Alkan a limited, non-exclusive license to host, process, and display your content only as needed to operate and improve the Service (for example, analysis and recommendation features).

You are responsible for ensuring your content and use of the Service comply with applicable laws and third-party rights.

7) Privacy

Your use of the Service is also governed by our Privacy Policy (English): see docs/PRIVACY_POLICY.md in this repository, or the same policy when published at a public URL inside the app or on a website. If the published URL and the repository file ever differ, the published version intended for users controls.

Please review it to understand how personal data is handled.

8) Intellectual Property

The Service, including software, branding, design, and non-user content, is owned by Fevzihan Alkan (or its licensors, where applicable) and protected by applicable intellectual property laws.

Except as expressly allowed by these Terms, no rights are granted to you.

9) Availability and Changes

We may update, modify, suspend, or discontinue any part of the Service at any time, including features, limits, and integrations.

We do not guarantee uninterrupted or error-free operation.

10) Disclaimers

The Service is provided on an "as is" and "as available" basis, to the maximum extent permitted by law.

Fevzihan Alkan disclaims warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Outfit analysis/recommendation outputs are informational and may not always be accurate or suitable for every situation.

11) Limitation of Liability

To the maximum extent permitted by law, Fevzihan Alkan will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Service.

Where liability cannot be excluded, it is limited to the minimum amount required by law.

12) Indemnification

You agree to defend, indemnify, and hold harmless Fevzihan Alkan from claims, liabilities, damages, losses, and expenses arising out of:

• Your use or misuse of the Service
• Your content
• Your violation of these Terms or applicable law

13) Termination

You may stop using the Service at any time and may request account deletion through in-app flows where available.

We may suspend or terminate your access if you violate these Terms or if needed to protect the Service, users, or legal compliance.

Sections that by nature should survive termination (for example, liability limitations and IP clauses) will remain in effect.

14) Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles, except where mandatory consumer protection rules in your country of residence require otherwise.

Subject to mandatory rules, the courts and enforcement offices of Istanbul, Türkiye shall have jurisdiction over disputes arising from these Terms, to the extent permitted by applicable law.

If a dispute arises, the parties should first attempt good-faith informal resolution by contacting alkanfevzihan@gmail.com.

15) Changes to These Terms

We may update these Terms from time to time. Updated Terms become effective when posted (or as otherwise stated). Continued use after updates means you accept the revised Terms.
